Every real estate project listed on Lend follows a fully compliant legal structure, designed to protect investors, guarantee ownership, and ensure clarity across all operations.

When a user invests, they immediately sign a bond agreement. This document is legally binding, nominative, and includes the wallet address and identity details provided during the process. It formalizes the investor’s position as a creditor of the SPV that owns the real estate asset.

The agreement is digitally signed through a certified third party, following the same standard as solutions like DocuSign. Once completed, the user’s onchain position is sealed through the mint of an opLend token.

This token represents full legal exposure to the underlying asset, covering both usufruct and bare ownership, and entitles the holder to all revenue and exit proceeds based on their share.

🏠 Asset Structure & SPV

Each project is managed through a dedicated SPV (Special Purpose Vehicle), incorporated either in France or in the country where the asset is located. SPVs are structured as subsidiaries under the Lend holding company, a registered SA.

Lend remains the only operational manager of each SPV, ensuring the property is sourced, managed, and maintained according to strict due diligence standards. Users are never exposed to synthetic exposure or wrapped assets. Their claim is directly linked to the legal entity holding the property.

All user deposits are locked in escrow during the funding phase. If a project doesn’t reach 100% of its funding goal before the end of the campaign, users are automatically refunded in full.

Once the campaign succeeds, the bond agreement is activated and funds are deployed.

All real estate assets on Lend are covered by appropriate insurance depending on their nature including property damage, rental risk, or short-term occupancy. These policies are tailored per deal and ensure maximum protection based on local legal requirements.
